SONETCH TERMS OF SERVICE Last Updated: 29 September 2026 Please read these terms before using SonEtch (the "Service"), including the mobile app, the dashboard at https://sonetch.scalerworks.com, and related transcription features. By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service. SonEtch is provided by ScalerWorks. Questions: support@scalerworks.com. 1. ACCEPTANCE OF TERMS By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use the Service. 2. THE SERVICE The Service lets you capture voice notes, request automated transcription using artificial intelligence (including Whisper), generate related bookmarks, and manage jobs and credits. The Service is provided on an "as is" and "as available" basis. 3. AI TRANSCRIPTION ACCURACY 3.1. We do not guarantee that transcriptions will be accurate, complete, or error-free. Accuracy can vary with audio quality, background noise, accents, specialised vocabulary, overlapping speech, and file format. 3.2. You are responsible for reviewing and correcting transcripts. Do not rely on automated transcription alone for legal, medical, or other high-stakes use without independent verification. We are not liable for errors in transcripts or for decisions you make based on them. 4. CREDITS AND PAYMENT 4.1. Transcription and some related features use credits. Credits are deducted when a job completes, regardless of transcript quality. 4.2. You may buy credits through the dashboard or, on Android, through Google Play in the app. Dashboard purchases are processed by Stripe. Google Play purchases are also subject to Google Play's terms and refund policies. Except where Google Play's policies or the law require otherwise, purchases are final and non-refundable. 4.3. Credits have no cash value and cannot be exchanged for money. Unused credits are not refunded if the Service is discontinued, suspended, or if your account is closed. We are under no obligation to provide refunds, compensation, or alternative services for unused credits. 4.4. We may change credit pricing or expiry with reasonable notice. 5. AVAILABILITY AND DISCONTINUATION 5.1. We do not guarantee uninterrupted or error-free service. The Service may be down for maintenance, faults, updates, or events outside our control. 5.2. We may change, suspend, or discontinue the Service, or any part of it, at any time, with or without notice, including for business, technical, legal, or economic reasons. 5.3. We are not obliged to keep the Service available indefinitely, to give advance notice, or to help you migrate data. In the event of discontinuation, unused credits are not refunded and access to the Service and stored data may end. 6. STORAGE 6.1. Audio and transcripts may be stored temporarily to process and deliver results. We reserve the right to delete files after processing or after a reasonable retention period. We do not guarantee permanent storage. Keep your own copies of anything important. 6.2. Local recordings on your device remain your responsibility to back up or delete. 7. ACCEPTABLE USE 7.1. You must not use the Service to process content that: - is illegal or that you do not have the right to record or upload; - infringes intellectual property or privacy rights; - contains confidential, proprietary, or sensitive information without authorisation; - is harassing, defamatory, or otherwise abusive; - contains malware or attempts to disrupt the Service. 7.2. You must not reverse engineer the Service, share your account, use automated access without permission, or use the Service to compete with or harm our business. 7.3. We may suspend or terminate accounts that breach these terms, immediately and without notice if you engage in prohibited activities. 8. YOUR CONTENT AND INTELLECTUAL PROPERTY 8.1. The Service, including all technology, software, and methods, is owned by ScalerWorks and protected by intellectual property laws. 8.2. You retain ownership of audio and other content you submit. You grant us a licence to process and store that content only to provide the Service. 8.3. Transcripts are provided for your use; the underlying technology remains ours. 9. ACCOUNTS 9.1. You must sign in with a Google account you are authorised to use. You are responsible for activity on that account. 9.2. You may close your account at any time using the deletion request at https://sonetch.scalerworks.com/account-deletion-request or by contacting support. 9.3. Upon termination, access ends, unused credits are forfeited, and data is deleted in line with the Privacy Policy at https://www.sonetch.scalerworks.com/privacy. 10. PRIVACY AND DATA SECURITY 10.1. We process personal data as described in the Privacy Policy at https://www.sonetch.scalerworks.com/privacy. 10.2. We implement security measures but cannot guarantee that the Service is free of vulnerabilities. You use the Service at your own risk. 10.3. In the event of a data breach, we are not liable for any damages resulting from security incidents. 11. FILE LIMITS Accepted audio formats and size limits may change. Files that exceed current limits (including a typical maximum around 100MB) may be rejected. Processing time is not guaranteed. 12. LIABILITY 12.1. To the maximum extent permitted by law, the Service is provided without warranties of any kind, including merchantability, fitness for a particular purpose, and non-infringement. ScalerWorks is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or use. 12.2. Our total liability for claims relating to the Service will not exceed the amount you paid for credits in the twelve months before the claim, or one hundred pounds (£100), whichever is greater. 12.3. Nothing in these terms limits liability that cannot be limited under English law, including for death or personal injury caused by negligence or for fraud. 13. INDEMNITY You will indemnify, defend, and hold harmless ScalerWorks and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: - your use of the Service; - your content; - your breach of these terms; - your violation of any rights of another party. 14. CHANGES We may change these terms. Material changes will be posted on the Service or otherwise reasonably notified (which may include email). Continued use after a change means you accept the new terms. If you do not agree, you must stop using the Service. 15. ACCOUNT TERMINATION BY USER 15.1. You may terminate your account at any time by contacting us or using account deletion features. 15.2. Upon termination: - your access to the Service will be revoked; - unused credits will be forfeited without refund; - your data will be deleted in accordance with our Privacy Policy and data retention practices. 16. GOVERNING LAW These terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, without affecting any mandatory consumer protections that apply where you live. 17. GENERAL PROVISIONS 17.1. ENTIRE AGREEMENT: These terms constitute the entire agreement between you and ScalerWorks regarding the Service and supersede all prior agreements. 17.2. SEVERABILITY: If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full effect. 17.3. WAIVER: Our failure to enforce any provision of these terms does not constitute a waiver of that provision. 17.4. ASSIGNMENT: You may not assign or transfer your rights or obligations under these terms without our written consent. We may assign these terms at any time. 17.5. CONTACT: ScalerWorks — support@scalerworks.com. 18.
